1. Introduction
These Terms & Conditions apply to all bookings and services provided by KidsDreamFactory NYC through nyc-kidsdreamfactory.com.
By submitting a booking request, paying a required deposit, or accepting a booking confirmation or invoice, the customer agrees to these Terms & Conditions.
Submitting an inquiry or booking form does not guarantee availability or reserve a party date. A reservation is considered confirmed only after the required deposit has been received and KidsDreamFactory NYC has issued written confirmation of the booking.
The person making the booking must be at least 18 years old and is responsible for ensuring that all applicable terms are followed by the guests attending the event.
2. Services Provided
KidsDreamFactory NYC provides party rental, styling and event services as described on our website and in the customer's individual booking confirmation, proposal or invoice.
Depending on the package selected, services may include sleepover and teepee setups, glamping experiences, themed décor, delivery, setup, styling, pickup and additional party services or add-ons.
The exact services included in each booking—including the event date, location, number of guests or setups, selected theme, rental items, add-ons and applicable fees—will be stated in the customer's booking confirmation or invoice.
Any changes requested after the booking has been confirmed are subject to availability and may result in additional charges. Changes are only considered accepted once confirmed in writing by KidsDreamFactory NYC.
All rental equipment and décor supplied by KidsDreamFactory NYC remain the property of KidsDreamFactory NYC unless specifically stated otherwise.
3. Booking and Payment
3.1 Booking Process To book our services, customers must submit a booking request and provide accurate and complete information.
A party date is not reserved by submitting an inquiry or booking form. A booking is confirmed only after the required 50% deposit has been paid and KidsDreamFactory NYC has provided written confirmation.
3.2 Payment Terms A 50% deposit is required to secure your booking. The remaining balance must be paid no later than 5 days before the scheduled event date.
If the remaining balance is not received by the due date, KidsDreamFactory NYC reserves the right to cancel the booking.
Payments may be made through our approved online payment processor using a valid credit or debit card.
3.3 Cancellation by Customer and Refund Policy Cancellation 4 weeks or more before the event:
Customers who cancel at least 4 weeks before the scheduled event date will receive a full refund of their deposit.
Cancellation less than 4 weeks before the event:
Payments are non-refundable for cancellations made less than 4 weeks before the scheduled event date.
Subject to availability, customers may request to reschedule the event to another date. Any rescheduling must be approved in writing by KidsDreamFactory NYC.
3.4 Cancellation by KidsDreamFactory If KidsDreamFactory NYC must cancel an event and is unable to provide the booked services, the customer will receive a full refund of all amounts paid for the cancelled services.
4. Delivery and Set-Up
4.1 Delivery and Collection Times KidsDreamFactory NYC will arrange delivery and setup on the scheduled event date and collection on the following day, unless otherwise agreed in writing.
Our standard goal is to complete delivery and setup by 3:00 PM on the event date and collect rental items by 12:00 PM the following day. Exact times may vary depending on traffic, building access, event location and scheduling.
Requests for specific delivery or collection times are subject to availability and may incur an additional fee.
Customers are responsible for providing timely and reasonable access to the event location, including any necessary building, elevator, parking or loading access.
4.2 Delivery Zone and Fees Standard delivery is included for locations within 15 miles of ZIP code 10019.
Additional travel fees apply as follows:
15–30 miles from ZIP code 10019: $50 travel fee
30–40 miles from ZIP code 10019: $85 travel fee
More than 40 miles: Please contact us for availability and pricing
Any applicable travel fee will be confirmed before the booking is finalized.
5. Customer Responsibilities
5.1 Suitable Event Space The customer is responsible for ensuring that the event location is clean, safe and suitable for the setup and use of the rented equipment.
The customer must provide sufficient space for the number of tents, mattresses, décor items or other equipment included in the booking.
KidsDreamFactory NYC reserves the right to refuse or modify a setup if the location presents a safety hazard or does not provide sufficient space or access for the booked services.
Customers should notify KidsDreamFactory NYC in advance of stairs, elevators, restricted building access, parking restrictions or other conditions that may affect delivery or setup.
5.2 Supervision and Duty of Care KidsDreamFactory NYC provides party rental, delivery, setup and styling services and does not provide childcare or supervision services.
A responsible adult must remain present and supervise children and guests throughout the event and while KidsDreamFactory NYC equipment is in use.
The customer is responsible for ensuring that guests use the rental equipment appropriately and follow any safety instructions provided by KidsDreamFactory NYC.
Nothing in these Terms & Conditions is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.
6. Damage, Loss, and Theft
6.1 Responsibility for Damage The customer is responsible for taking reasonable care of all rental equipment and décor while it is in their possession.
The customer may be charged for loss, theft, or damage beyond normal wear and tear that occurs during the rental period.
Any charge will be based on the reasonable cost of cleaning, repair, or replacement of the affected item. KidsDreamFactory NYC will determine whether an item can reasonably be repaired or must be replaced.
Normal wear and tear will not be charged to the customer.
6.2 Exit Due to Inappropriate Conduct KidsDreamFactory NYC reserves the right to stop setup, suspend services, or leave the event location if our team reasonably believes that conditions are unsafe or if our staff experiences threatening, abusive, discriminatory, illegal, or seriously disruptive conduct.
If services cannot be completed because of such conduct by the customer or their guests, amounts already paid may be non-refundable to the extent permitted by applicable law.
7. Limitation of Liability
7.1 Disclaimer of Warranties KidsDreamFactory NYC will use reasonable care in providing its rental equipment, delivery, setup, styling, and related services.
The customer is responsible for supervising children and guests and for ensuring that rental equipment is used only as intended.
7.2 Limitation of Liability To the fullest extent permitted by applicable law, KidsDreamFactory NYC will not be responsible for indirect, incidental, special, or consequential losses arising from the use of our services or rental equipment.
Nothing in these Terms & Conditions excludes or limits liability where such liability cannot legally be excluded or limited, including liability arising from gross negligence, reckless conduct, or intentional misconduct.
7.3 Liability to Third Parties KidsDreamFactory NYC is not responsible for loss, damage, or injury caused solely by the actions of customers, guests, venue personnel, or other third parties outside the reasonable control of KidsDreamFactory NYC.
The customer remains responsible for the conduct and supervision of their guests during the event.
8. Environmental and Safety Requirements
8.1 Non-Smoking and Pet-Free Environment All rental equipment must be kept in a smoke-free environment throughout the rental period.
Pets must be kept away from tents, bedding, mattresses, décor, and other rental equipment.
Shoes must be removed before entering or using the tents.
Food, beverages, candy, and other items that may stain or damage rental equipment should not be used inside the tents unless specifically approved by KidsDreamFactory NYC.
8.2 Prohibited Items and Activities To protect the safety and condition of our rental equipment, the following items are not permitted inside or directly around the tents:
Shoes or wet items
Paint, markers, nail polish, slime, glitter, or similar craft materials
Food, beverages, or candy
Pets
Open flames, candles, or other heat-producing items
Any activity that may reasonably cause damage to the rental equipment
If rental equipment requires additional cleaning, repair, or replacement because of prohibited items or activities, the customer may be charged the reasonable cost of cleaning, repair, or replacement as described in Section 6.
9. Photography and Media Usage
KidsDreamFactory NYC respects the privacy of our customers and their guests.
We may photograph our party setups, rental equipment, and décor for portfolio, website, social media, or promotional purposes when no identifiable customer or guest is featured.
KidsDreamFactory NYC will not use photographs, videos, names, likenesses, or other identifiable images of customers or guests for advertising, social media, website, or other promotional purposes without appropriate written consent.
For any identifiable image of a minor, written permission from the minor's parent or legal guardian must be obtained before the image is used for promotional purposes.
Any permission to use photographs or videos for promotional purposes may be requested through a separate voluntary photo and media release and is not required as a condition of booking our services.
10. Use of Content
All content on this Site, including text, photographs, graphics, logos, designs, and other materials, is owned by or licensed to KidsDreamFactory NYC and is protected by applicable intellectual property laws.
Content from this Site may not be copied, reproduced, distributed, modified, or used for commercial purposes without prior written permission, except as otherwise permitted by law.
11. Changes to Terms
KidsDreamFactory NYC may update these Terms & Conditions from time to time. The updated version will be posted on this Site together with the date of the most recent revision.
Changes will generally apply to bookings made after the updated Terms are posted. A confirmed booking will remain subject to the Terms accepted at the time of booking unless the customer and KidsDreamFactory NYC agree otherwise in writing or a change is required by applicable law.
12. Governing Law and Jurisdiction
These Terms & Conditions and the services provided by KidsDreamFactory NYC shall be governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute arising from these Terms or our services shall be brought before a court of competent jurisdiction in the State of New York, unless applicable law provides otherwise.
